November 2023 saw an already controversial decision of the Tax Court holding that limited partners in name may be subject to self-employment tax if they act as general partners. The month featured two extremely interesting cases: one where a former husband was taxed on $350,000 paid to his ex-wife and another where the Tax Court permitted retirement plan contributions to be made on behalf of two employees who received no compensation.
